Privacy and Data Security Policy
This document outlines the privacy and data security obligations of Service Centre Dealerships associated with the PM Surya Ghar Muft Bijli Yojana Scheme (hereinafter referred to as “the Scheme”), managed by Bengal Sun Solar Energy (I) Pvt. Ltd. (hereinafter referred to as “Bensun®”). By participating as a Service Centre Dealership in the Scheme, you agree to abide by the terms and conditions set forth below.
1. Definitions
- Service Centre Dealership: Any individual, entity, or organization authorized to promote, distribute, or execute the Scheme’s initiatives.
- Customer Data: Any information, personal or otherwise, collected from customers, including but not limited to name, contact details, address, identification documents, and energy consumption data.
- Sensitive Information: Information that includes but is not limited to Aadhaar numbers, bank details, and other personally identifiable information (PII) as defined by applicable laws.
2. Privacy and Confidentiality
2.1 Data Collection
Service Centre Dealerships shall collect Customer Data strictly in accordance with the guidelines and formats provided by Bensun®.
2.2 Purpose Limitation
Customer Data collected shall only be used for purposes directly related to the implementation and execution of the Scheme.
2.3 Confidentiality
Service Centre Dealerships shall maintain the confidentiality of all Customer Data and Sensitive Information. Under no circumstances should this data be shared, sold, or disclosed to unauthorized parties.
3. Data Security Obligations
3.1 Secure Storage
All Customer Data must be securely stored, whether in physical or digital formats, using industry-standard security measures.
3.2 Access Control
Access to Customer Data should be restricted to authorized personnel only. Proper authentication mechanisms must be in place to prevent unauthorized access.
3.3 Data Breach Notification
In the event of a data breach, Service Centre Dealerships must notify Bensun® within 24 hours of discovering the breach. The notification must include details of the breach, affected data, and immediate corrective actions taken.
4. Compliance with Applicable Laws
Service Centre Dealerships must comply with all applicable local, national, and international data protection and privacy laws, including but not limited to the Information Technology Act, 2000, and its associated rules.
5. Prohibited Activities
- Using Customer Data for marketing, advertising, or any purposes unrelated to the Scheme.
- Sharing Customer Data with third-party entities without explicit authorization from Bensun®.
- Retaining Customer Data beyond the period necessary for executing the Scheme’s activities.
6. Advertisement Policies
6.1 Shop Display & Branding Materials
Service Centre Dealership agrees to branding the shop as per the Bensun® branding & display policy, where the storefront should be properly decorated and the inside of the shop should be fabricated as per the brand norms…
7. Revenue & Earnings Terms
All the revenue & earning terms and amounts associated with this partnership is subject to change at the sole discretion of Bengal Sun Solar Energy (I) Pvt. Ltd. (Bensun®). 8. Business Generation and Dealer Responsibilities

This Agreement does not constitute a guarantee or commitment by the Brand to generate business for the Service Dealer…
9. Audit and Monitoring
Bensun® reserves the right to audit Service Centre Dealerships’ data management practices to ensure compliance with these terms. Non-compliance may result in penalties, including termination of the partnership.
10. Penalties for Non-Compliance
- Immediate termination of partnership.
- Legal action under applicable laws.
- Financial penalties as determined by Bensun®.
11. Amendments
Bensun® reserves the right to amend these terms as necessary. Service Centre Dealerships will be notified of any changes, and continued participation will constitute acceptance of the updated terms.
12. Acknowledgment
By signing below, the Service Centre Dealership acknowledges that they have read, understood, and agreed to the privacy and data security terms outlined in this document.

I/We, the undersigned, hereby confirm that we have read, understood, and agree to abide by the Terms and Conditions outlined above. By signing this declaration, we acknowledge that we are fully aware of the terms, requirements, and obligations specified and accept them without reservation.
